Nintendo Australia has confirmed that purchases made on DSiWare cannot be transferred over to a new DSi system. When games are downloaded, they are locked to that system. No doubt to prevent people giving each other games. If your system does pack in, you're advised to send it to Nintendo who will transfer purchased titles over for you.
